Mediation is a process related to the settlement of a dispute between the parties on the basis of mutual agreement with the mediation of a mediator (mediators). Mediation aims to reduce the level of conflict between the parties and ensure a satisfactory resolution of the dispute.
Mediation can be applied to disputes arising from civil cases, commercial disputes, family, labor and administrative law relations. However, for commercial disputes, as well as disputes arising from family and labor relations, participation in an initial mediation session is mandatory before going to court. It is not possible to go to court regarding these types of disputes without participating in the initial mediation session.
In order to start the mediation process, one of the parties must send a mediation proposal to the other, or an agreement on the application of the mediation process can be concluded between the parties. The duration of the mediation process is 30 days, but with the agreement of the parties, this period can be extended up to another 30 days. The mediation process may involve one or more sessions.
